Thank you for using EDKA! We’re excited to help you manage your Kubernetes infrastructure. These Terms of Service (“Terms”) explain the rules and responsibilities for using our platform.

1. The Basics

What We Do

EDKA provides a platform to manage Kubernetes clusters on your own infrastructure provider accounts (primarily Hetzner). We help you provision, configure, and maintain Kubernetes clusters, but the underlying infrastructure remains under your control and responsibility.

By using EDKA, you agree to these Terms. If you don’t agree, please don’t use our services.

2. Definitions

To keep things clear, here’s what we mean by:

  • “EDKA Platform”: Our web-based management interface and APIs for Kubernetes cluster management
  • “Your Infrastructure”: The Hetzner account and resources you own and control
  • “Clusters”: Kubernetes clusters provisioned through EDKA on Your Infrastructure
  • “Customer Data”: Any data you store, process, or transmit through your Clusters
  • “Service Credentials”: API keys, tokens, and credentials you provide to EDKA to manage Your Infrastructure

3. Shared Responsibility Model

This is crucial to understand. EDKA operates on a shared responsibility model:

EDKA is Responsible For:

Platform Security

  • Securing the EDKA management platform
  • Protecting your account credentials and Service Credentials
  • Encrypting data in transit and at rest within our platform
  • Maintaining secure APIs and web interfaces
  • Regular security updates to our platform code

Platform Operations

  • Providing cluster provisioning templates and automation
  • Maintaining the EDKA control plane
  • Delivering platform updates and new features
  • Providing technical support for platform issues
  • Monitoring our platform’s availability

You are Responsible For:

Infrastructure Security

  • Securing your Hetzner account with strong passwords and 2FA
  • Managing access controls to your infrastructure provider account
  • Paying infrastructure costs directly to Hetzner
  • Maintaining security of resources outside EDKA’s management scope

Cluster Security

  • Securing your Kubernetes clusters after provisioning
  • Managing cluster access controls (RBAC, network policies)
  • Keeping workloads secure and updated
  • Implementing security best practices for your applications
  • Monitoring and responding to security events in your clusters
  • Backing up your data and applications

Compliance and Data

  • Ensuring compliance with regulations applicable to your use case
  • Protecting Customer Data within your clusters
  • Managing secrets and sensitive configuration
  • Implementing data encryption for your applications

Shared Responsibilities:

Security Updates

  • EDKA provides update notifications and tooling
  • You decide when and how to apply updates to your clusters

Incident Response

  • EDKA assists with platform-related incidents
  • You handle incidents within your clusters and infrastructure

4. Account and Access

Account Security

  • You must provide accurate registration information
  • Keep your account credentials confidential
  • Use strong, unique passwords
  • Enable two-factor authentication
  • Immediately notify us of unauthorized access

Service Credentials

When you provide infrastructure provider credentials to EDKA:

  • We encrypt them using industry-standard encryption (AES-256) and store them in a dedicated secret storage system
  • We use them only to perform requested operations
  • We never share them with third parties
  • You can revoke them at any time and some cluster operations can use tokens on the fly. We’ll use them for the duration of the operation and do not store them.
  • You remain responsible for their security at the provider level

5. Acceptable Use

You agree not to use EDKA to:

Prohibited Activities

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Mine cryptocurrency without explicit permission
  • Run malicious code or malware
  • Attempt unauthorized access to any systems
  • Interfere with or disrupt our services

Resource Usage

  • Use resources reasonably and responsibly
  • Not abuse our support services
  • Follow rate limits and usage guidelines

6. Payment Terms

Billing

  • Subscription Model: Pay monthly or annually in advance
  • Usage-Based Charges: Additional fees for premium features or support
  • Infrastructure Costs: You pay Hetzner directly for infrastructure
  • Currency: All prices are in EUR unless otherwise specified

Payment Policies

  • Non-Refundable: Payments are non-refundable, except where we agree a service issue occurred or if you are not satisfied with the service
  • Price Changes: 30 days notice for price increases
  • Late Payments: Services may be suspended after 14 days of non-payment
  • Taxes: You’re responsible for applicable taxes

7. Service Level and Support

Platform Availability

  • We target 99.9% uptime for the EDKA platform
  • This does not cover the availability of your clusters. Your clusters continue running independently, except in the case of Hetzner outages
  • Scheduled maintenance with 48 hours notice
  • Status updates at status.edka.io

Support

  • Free Plan: Limited support via email
  • Standard and Pro Plans: Email support and in-app chat support
  • Enterprise Plan: Priority support with SLA

Limitations

  • We don’t guarantee cluster uptime (that depends on your infrastructure)
  • We’re not responsible for Hetzner provider outages
  • Support covers EDKA platform issues, not general Kubernetes consulting, except for enterprise plans.

8. Data and Privacy

Your Data

  • You own all your Data in your clusters
  • We don’t access your data unless you request support
  • You’re responsible for data backups within your clusters. We provide tools to facilitate that
  • You can disconnect your clusters from EDKA and manage them within your Hetzner account at any time

Our Data

  • We collect platform usage metrics
  • See our Privacy Policy for details

9. Intellectual Property

Our Intellectual Property

  • EDKA platform code and designs are our property
  • You get a license to use, not own, our services
  • Don’t reverse engineer or copy our platform

Your Intellectual Property

  • You retain all rights to your applications and data
  • You grant us only the rights needed to provide services
  • We won’t use your IP for anything else

10. Warranties and Disclaimers

What We Promise

  • We’ll provide services with reasonable skill and care
  • We’ll maintain industry-standard security practices
  • We’ll notify you of significant changes

What We Don’t Promise

  • THE SERVICES ARE PROVIDED “AS IS”
  • We don’t guarantee uninterrupted or error-free service
  • We don’t warrant that services will meet all your requirements
  • We’re not responsible for third-party service issues

11. Limitation of Liability

Maximum Liability: Our total liability is limited to the fees you paid to Edka in the 12 months preceding the incident.

Warranties and Disclaimers: Nothing in these Terms affects rights you may have under applicable consumer laws that cannot be waived by contract.

Excluded Damages: We’re not liable for:

  • Indirect or consequential damages
  • Lost profits or business opportunities
  • Data loss (you should always have backups)
  • Third-party claims
  • Issues with your infrastructure provider

Your Infrastructure: We’re specifically NOT liable for:

  • Security breaches in your Hetzner account as a result of actions outside of our platform
  • Misconfiguration of your clusters as a result of direct actions on your infrastructure, not through our platform
  • Application-level vulnerabilities
  • Infrastructure provider outages

12. Indemnification

You’ll defend and indemnify EDKA from claims arising from:

  • Your use of the services
  • Violation of these Terms
  • Your Customer Data
  • Security breaches in Your Infrastructure
  • Disputes with your infrastructure provider

13. Termination

By You

  • Cancel anytime through your account dashboard
  • Effective at the end of your billing period
  • Export your data before termination

By Us

  • For Terms violations with 14 days to remedy
  • Immediately for severe violations or illegal activity
  • For non-payment after 14 days notice

After Termination

  • Access to EDKA platform ends
  • Your clusters continue running (you still control them)
  • We delete your data immediately. However, we do not delete provisioned resources in your Hetzner account. You remain responsible for removing or managing them.
  • Some Terms survive (like liability limits)

14. Changes to Terms

  • We’ll notify you of material changes 30 days in advance
  • Notice via email and platform dashboard
  • Continued use means acceptance
  • You can terminate if you disagree

15. Dispute Resolution

Informal Resolution

Let’s try to work things out first. Email legal@edka.io with concerns.

Formal Disputes

  • Governing Law: Spanish and EU law
  • Jurisdiction: Courts of Barcelona, Spain
  • Language: English or Spanish
  • No Class Actions: Individual claims only

16. Enterprise Customers

Enterprise customers may have additional terms including:

  • Custom SLAs
  • Dedicated support
  • Compliance assistance
  • Negotiated liability terms
  • Managed services options

17. Third-Party Services

Infrastructure Providers

  • You contract directly with Hetzner
  • We’re not party to your infrastructure agreements
  • Provider outages aren’t our responsibility
  • You must comply with provider terms

Integrations

  • Third-party integrations are provided “as is”
  • We’re not responsible for third-party service changes
  • Review third-party terms before using integrations

18. Miscellaneous

Entire Agreement

These Terms and referenced policies are the complete agreement.

Severability

If any part is invalid, the rest remains in effect.

Waiver

Not enforcing a right doesn’t waive it.

Assignment

You can’t transfer these Terms without our consent.

Force Majeure

Neither party is liable for delays beyond reasonable control.
